This Disclaimer applies to information published on chartscribe.ai, including information about the ChartScribe web and mobile applications, clinical-documentation templates, ChartScribe Pin, and related products and services (collectively, the “ChartScribe Offerings”). It also explains important safety and use limitations for ChartScribe output. It supplements our Terms of Service and Privacy Policy.
Important clinical safety notice. ChartScribe creates draft documentation. It does not independently diagnose, make or validate clinical recommendations, or provide care, and it does not replace professional judgment. A qualified clinician must independently review, correct, and approve every draft before it is relied on for care, finalized, signed, submitted for billing, or placed in an electronic health record. Any draft shared for review must remain clearly identified as a draft and be limited to authorized recipients.
1. Documentation aid—not medical advice
ChartScribe is designed to assist healthcare professionals with clinical documentation. ChartScribe is not a healthcare provider, does not practice medicine, and does not create a clinician-patient relationship. It is not intended to independently examine patients, make or confirm diagnoses, determine medical necessity, recommend or validate treatment, issue orders, prescribe medication, or make triage decisions.
Website, blog, template, example, and product content is provided for general informational purposes. It is not medical, legal, regulatory, compliance, coding, billing, or other professional advice. Patients and other members of the public should not use the ChartScribe Offerings to self-diagnose or make treatment decisions and should seek advice from a qualified healthcare professional.
ChartScribe is not an emergency, patient-monitoring, or alerting service. Do not use it for emergencies or time-critical clinical decisions. If you believe someone may be experiencing a medical emergency, contact local emergency services immediately.
2. AI-generated output requires clinician review
Transcriptions, summaries, charts, and other AI-generated output may be incomplete, inaccurate, misleading, or unsuitable for a particular patient, encounter, specialty, or purpose. Among other things, output may:
- omit clinically relevant information or add unsupported content;
- misidentify a speaker or confuse current, historical, suspected, ruled-out, and confirmed information;
- misstate negation, medications, allergies, doses, units, measurements, dates, laterality, results, diagnoses, instructions, or follow-up; or
- place content in the wrong section, preserve inappropriate template text, or present discussed options as completed actions or orders.
Output can appear fluent, confident, and well organized even when it is wrong. Quality may also vary with audio quality, background noise, speaker overlap, connectivity, source completeness, and the selected template.
Before relying on any output, an authorized clinician must confirm the patient, encounter, and source material; compare the draft with the encounter and available record; verify all material facts; correct errors and omissions; add findings and clinical reasoning that were not captured; and decide what belongs in the final record. ChartScribe output must never be the sole basis for diagnosis, treatment, medication, orders, referrals, follow-up, or any other clinical decision.
3. Professional and recordkeeping responsibility
Users and their organizations remain responsible for the accuracy, completeness, relevance, timeliness, and lawful use of final clinical documentation. They are also responsible for meeting applicable professional, organizational, payer, coding, billing, signature, attestation, retention, and recordkeeping requirements. A generated statement, completed field, or template heading does not establish that an examination or service occurred, that a diagnosis or result is correct, that medical necessity exists, or that a coding or billing requirement has been met.
Unless expressly stated in a written agreement, “EHR-ready” refers to a workflow in which a user can transfer reviewed content into an electronic health record; it does not promise direct integration or error-free transfer. After any copy, paste, export, or other transfer, the user must verify the destination patient and encounter, confirm that no content was truncated, altered, duplicated, or misplaced, and complete the EHR’s required review and signature process.
4. Recording, notice, consent, and authorization
Before recording, uploading, transcribing, or otherwise processing a conversation or file, users must have the legal right and appropriate authorization to do so. Users and their organizations are responsible for providing and documenting all required notices and obtaining all required consents or authorizations from patients, participants, guardians, and other affected individuals.
Recording, privacy, telehealth, professional-practice, employment, record-retention, and health-information laws vary by jurisdiction and context. Additional requirements may apply to minors, individuals who cannot consent, multi-party conversations, substance-use-disorder records, and especially sensitive information, including under 42 C.F.R. Part 2 where applicable. Users must follow the laws, professional duties, contracts, and organizational policies that apply to their use and must avoid capturing bystanders or unrelated conversations.
5. Privacy, HIPAA, and security
References to HIPAA compliance, privacy, encryption, or security on this website describe ChartScribe safeguards and product workflows. They do not, by themselves, make a user, healthcare organization, device, network, or end-to-end workflow compliant with HIPAA or any other law, and they do not make every generated chart “HIPAA-compliant.” Users and their organizations remain responsible for their own risk analysis, access controls, account and device security, workforce practices, minimum-necessary use where applicable, retention settings, and downstream handling of protected or sensitive information.
Where a business associate agreement, data processing agreement, or other contract is required, users must not submit protected health information until the appropriate agreement is in effect. Data handling is governed by the Privacy Policy and any applicable customer agreement. Do not send protected health information through the public website’s contact email or other unapproved channels. No electronic system or transmission method can be guaranteed to be completely secure or continuously available.
6. No guaranteed results
ChartScribe does not guarantee that the ChartScribe Offerings or any output will be accurate, complete, error-free, uninterrupted, compatible with every system, or suitable for every specialty, patient, encounter, or jurisdiction. ChartScribe also does not guarantee particular clinical outcomes, documentation quality, time or cost savings, productivity gains, reimbursement, or regulatory compliance. Testimonials, examples, demonstrations, previews, and workflow descriptions are illustrative; they are not promises that every user will achieve the same result.
7. ChartScribe Pin and unreleased features
ChartScribe Pin and any feature identified as upcoming, preview, beta, waitlist-only, or unreleased may change before or after release. Images, specifications, battery-life estimates, connectivity, functionality, pricing, availability, and release timing are preliminary unless confirmed in final product materials or a written agreement. Joining a waitlist is not a purchase or preorder and does not reserve a device or guarantee availability by a particular date.
Any separate written warranty provided with a released device, and any statutory consumer right that cannot be waived, remains unaffected. A product-specific warranty controls for the hardware if it conflicts with this Disclaimer.
8. Third-party services and links
The website and ChartScribe Offerings may refer or link users to independent third-party websites, application stores, EHR systems, devices, software, or services. Those independent third parties operate under their own terms and privacy practices. ChartScribe does not control and does not endorse an independent third party merely by linking to or supporting access to it, and cannot guarantee its availability, accuracy, compatibility, security, or performance. This section does not alter ChartScribe’s obligations for vendors or subprocessors acting on its behalf under applicable law or contract.
9. Warranties and liability
Except for commitments expressly stated in an applicable binding agreement or product-specific warranty, and to the fullest extent permitted by law, the ChartScribe Offerings and website content are provided “as is” and “as available.” ChartScribe disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability, to the extent those warranties may lawfully be disclaimed.
Any applicable limitations of liability are governed by the Terms of Service and other binding agreements that apply to the user. To the fullest extent permitted by law, ChartScribe is not responsible for loss or harm arising from reliance on unreviewed or inaccurate output, use for clinical decision-making, placement in the wrong record, a user’s failure to obtain required consent or authorization, unlawful or unauthorized use, or independent third-party products and services. Nothing in this Disclaimer excludes or limits liability that cannot lawfully be excluded or limited.
10. Updates and contact
We may update this Disclaimer as the ChartScribe Offerings, our practices, or applicable requirements change. The “Last updated” date shows when this version was revised. If this Disclaimer conflicts with an applicable binding agreement, business associate agreement, data processing agreement, or product-specific warranty, that document controls to the extent of the conflict.
